Terms of Service

1. Account Terms

You must provide a valid email address to create a WarpLink account. You are responsible for maintaining the security of your account credentials, and WarpLink is not liable for any loss or damage arising from your failure to do so. One person or legal entity may maintain multiple organizations, each with its own billing and team.

2. Acceptable Use

You agree not to use WarpLink to:

  • Create links that redirect to malware, phishing pages, or fraudulent content
  • Distribute spam or unsolicited messages via short links
  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Transmit content that is unlawful, harmful, or objectionable
  • Attempt to gain unauthorized access to WarpLink systems or other users' accounts

We reserve the right to disable links and suspend accounts that violate this policy, with or without notice.

3. API Usage Limits

All API keys are rate limited to 60 requests per minute. Exceeding this limit results in HTTP 429 responses. Click limits are enforced per billing period. When the free tier click limit is exceeded, link redirects continue to work but analytics access is gated behind an upgrade prompt.

5. Service Availability

WarpLink strives for high availability but does not guarantee a specific uptime percentage. No service level agreement is provided on the free tier, and paid plans receive priority support. We are not liable for downtime caused by third-party infrastructure providers, scheduled maintenance, or force majeure events.

6. Intellectual Property

WarpLink and its original content, features, and functionality are owned by WarpLink and protected by applicable intellectual property laws. Our SDKs are released under the MIT license. You retain all rights to the content you create and the links you configure through the service.

7. Billing and Subscriptions

Paid subscriptions are billed in 30-day billing periods through Stripe. You can upgrade, downgrade, or cancel your subscription at any time from the dashboard. Downgrades take effect at the end of the current billing period. Refunds are handled on a case-by-case basis; contact support within 7 days of a charge for consideration.

8. Data Ownership

You own all link configurations, analytics data, and content you create through WarpLink. You may export your click analytics as CSV from the dashboard at any time. We retain the right to store anonymized, aggregated analytics for service improvement.

9. Termination

You may terminate your account at any time by deleting it from your dashboard settings. We may terminate or suspend your account for violation of these terms, with notice when feasible. Upon termination, your links stop redirecting and your associated data is removed immediately through a cascading deletion, except where we are required by law to retain certain records.

10. Warranty Disclaimer

WarpLink is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error free, or completely secure.

11. Limitation of Liability

To the maximum extent permitted by law, WarpLink shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless WarpLink and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses, including reasonable legal fees, arising from your content, the destinations your links point to, your use of the service, or your violation of these terms or applicable law.

13. Dispute Resolution and Venue

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at legal@warplink.app and allowing 30 days to reach a resolution. If the dispute is not resolved, it will be brought exclusively in the courts of the Province of Ontario, and you and WarpLink consent to personal jurisdiction there.

14. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict-of-laws rules.

15. Severability

If any provision of these terms is held to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Assignment

You may not assign or transfer these terms without our prior written consent. WarpLink may assign these terms in connection with a merger, acquisition, reorganization, or sale of assets.

17. Entire Agreement

These terms, together with our Privacy Policy, constitute the entire agreement between you and WarpLink regarding the service and supersede any prior agreements.

18. Modifications

We may modify these terms at any time. Material changes will be communicated via the email address associated with your account at least 14 days before they take effect. Continued use of WarpLink after modifications take effect constitutes acceptance of the updated terms.
